Early this Sunday morning, Roxana “N” was formally indicted for her probable responsibility in the crime of homicide by omission with *dolus eventualis* (indirect intent), after her son, Vicente, died following being locked inside a vehicle for more than 12 hours in Mexicali, Baja California.
During the hearing—which lasted approximately 16 hours—a control judge determined the woman’s potential culpability regarding the aforementioned crime, after she forgot her 3-year-old son inside her SUV upon arriving at the La Rioja residential subdivision, where they both lived.
During the proceedings, the woman’s defense counsel requested that the charge be reclassified as involuntary manslaughter; however, the judge ruled that there was sufficient evidence to proceed with the case under the charges presented by the Baja California State Attorney General’s Office (FGE).
According to reports, her lawyers presented psychological expert analyses and testimonies indicating that Roxana “N” was allegedly living in an environment of domestic violence and was struggling with depression, anxiety, and financial difficulties, in addition to undergoing medical treatment for pre-existing emotional conditions.
Statements were also presented by family members, friends, and a former partner of Roxana “N”; these individuals described her as an attentive mother but noted that, in recent months, she had exhibited signs of emotional deterioration.
