A judge granted house arrest to Carlota N., the elderly woman facing criminal charges for aggravated homicide.
The judge on duty at the Chalco state prison granted the injunction issued by the Sixth District Court of the Federal Judiciary.
Doña Carlota N., 74 years old, was charged with firing a gun at alleged squatters in a family home located in the Ex Hacienda de Guadalupe housing complex in the community of La Candelaria Tlapala.
The incident occurred in March 2025, when the woman and two of her children shot at a family who had illegally occupied her property. Two people died and one was injured in the altercation.
The judge at the Chalco prison ordered house arrest instead of pretrial detention. He also set bail at 250,000 pesos; prohibited her from approaching the victims and those affected; and barred her from approaching the home of the minor, identified by the initials C.C.B., or his school.
It should be noted that a minor was wounded by gunfire during the shootout.
Ms. Carlota will be allowed to remain at her home in the Iztapalapa borough of Mexico City and is prohibited from leaving the country.
Last year, a lower court judge denied the family’s request, which was granted by their legal counsel. They then filed an appeal, which was successful.
The federal courts granted the request based on the arguments presented: her advanced age, declining health, diabetes that worsened in prison, and her need for insulin.
Meanwhile, Eduardo N and Mariana N, Carlota’s children, will remain in custody while their legal proceedings continue, as they face charges related to the property dispute.
In February 2026, a judge in the same prison sentenced Víctor Eladio Pérez Ortiz (or Torres Ortiz) to six years in prison for the crime of dispossessing Mariana N’s property.
With this conviction, it was established that the property legitimately belongs to Carlota N’s family; a fact already acknowledged by the Attorney General’s Office following the investigation conducted by the Public Prosecutor’s Office.
