After more than a decade without progress in his location, the federal court in Jalisco determined that the statute of limitations on the criminal case for organized crime against Nemesio Oseguera Cervantes, better known as El Mencho, leader of the Jalisco New Generation Cartel (CJNG), had expired.
The ruling, issued by the Sixth District Court for Criminal Matters, rescinded the arrest warrant issued in 2012 due to the expiration of the legal deadlines for executing the arrest in connection with a kidnapping case in Zapopan, Zeta Tijuana reported this Monday.
The judge argued that, because the legal time to arrest Oseguera Cervantes had expired, the criminal case was extinguished.
According to the aforementioned media outlet, the Attorney General’s Office (FGR) has already filed an immediate appeal, arguing that this action leaves the victims defenseless.
The case will now be reviewed by the First Collegiate Court of Appeals of the Third Circuit, where the case has already been forwarded to appoint a reporting judge and prepare the draft ruling that will confirm, modify, or revoke the resolution.
